What are the legal tools that Union health and safety representatives can use to protect workers in the workplace at all times and especially during the Pandemic?
The various OHS Acts around the country provide union health and safety representatives with serious power to protect workers and their H&S rights.
We will look at the right questions to ask employers, the duties to protect workers’ rights, consultative powers, as well as the powers of reviewing and critiquing employer OHS programs.
Union health and safety representatives are the conduit to health and safety related information in the workplace and should use the legal powers bestowed upon them to conduct inspections, investigations and risk assessments. We are also involved in work refusals and have the power, in some jurisdictions, to be a part of bilateral work stoppages. We will look at the power of appeals and the strength of collective bargaining.
